Board of Zoning Appeals MinutesCITY OF NORTHVILLE CALL TO ORDER: Commissioner Stapleton called the meeting to order at 7:30 P.M. ROLL CALL: Commissioners: Present: Absent: None. Also Present: MINUTES: Motion by Cronin, supported by Haveraneck to approve the minutes of the regular meeting of September 5, 2001. Voice Vote: Ayes: All: Nays: None. Motion Unanimously Carried. CASE #01-12 David Farhat 210 S. Rogers Northville, Michigan 48167 The applicant requests a variance to Northville Zoning Ordinance - Section 3.04 - Area Height and Placement. The required setback is 5’ and the applicant is requesting a 3’ setback. GROUNDS FOR APPEAL: Undo Hardship. Dave Farhat, the applicant stated that because of an in ground swimming pool with surrounding cement, the area for a new 22’ x 28’ garage is limited. An elderly neighbor at the south lot line has erected a fence, which extends 2 feet beyond her lot line on to his property. He asked to place his garage 3’ from the south lot line. COMMISSIONER COMMENTS AND CONCERNS: Additional information needs to be provided showing supporting evidence of the location of the pool and the neighbor’s fence. The applicant is looking for a variance from a "fence" which is not an established line. A survey of the property needs to be provided to determine the actual lot lines. Motion by Ayers, supported by Maise to table the application until additional, accurate and verifiable information is provided. The motion includes the provision that if a variance is not needed, than the BZA application fee should be refunded administratively. Voice Vote: Ayes: All: Nays: None. Motion Unanimously Carried.
