1. CALL TO ORDER:

Commissioner called the meeting to order at 7:30 P.M.

3. APPROVAL OF AGENDA:

Motion by, supported by Gazlay to approve the agenda. Voice Vote: Ayes: All. Nays: None.

Motion Unanimously Carried

4. MINUTES:

Motion by Lokey, supported by to approve the minutes of the regular meeting of February 4, 2004. Voice Vote: Ayes: All. Nays: None. Motion Unanimously Carried.

Applicant requests variance from Sec. 14-84 of the Zoning Ordinance (Location of condenser). Requesting to place an A/C condenser unit on The northwest side of the home.

The applicant requests a variance from Section 14.84 (Location of A/C condenser) in order to place an Air Condenser in the side yard. Grounds for Appeal: UNDUE HARDSHIP.

The applicant stated that the A/C unit has already been installed on the north west side of the home. The contractor stated that he wasn’t aware of the Ordinance. The homeowners have paid the contractor in full

for the work and also, weren’t aware of the ordinance.

COMMISSIONER COMMENTS AND CONCERNS: The commissioners questioned why the AC unit was not installed on the south west side of the home which would have been a better location as opposed to the north west side. Concerns were expressed regarding contractors who arbitrarily install the units without registering and obtaining a permit with the City’s Building Department.

Motion by Bress, supported by Durst to grant the variance. Roll Call Vote: Ayes: Maise, Bress, Lokey Ayers, Durst. Nays: Stapleton. Motion Carried.

 

6. DISCUSSION:

Gary Word, the City Manager, invited the BZA members to attend a special meeting called by the City Council on Tuesday, March 23, 2004 at 7:00 PM in the Council Chambers. The purpose of this meeting is to review preliminary conceptual parking structure(s) designs.

Gary Word also reported that on March 2, 2004 the Planning Commission rejected Our Lady of Victory’s request for the Special Land Use Permit to build a new elementary school. OLV’s appeal will probably be first to the Board of Zoning Appeal for a Special Use Permit.

Motion by Maise, supported by Durst to adjourn at 8:20 PM. Voice vote: Ayes: All: Nays: None. Motion Unanimously Carried.
